A legal action has been initiated in the United States Court of International Trade challenging the tariffs imposed by President Donald Trump on Canada. Filed by the non-profit organization Liberty Justice Center on behalf of U.S. food importer Gellert Global Group, the lawsuit argues that Trump’s utilization of Section 338, a trade statute from the 1930s never previously enacted, exceeds his presidential authority.

Trump implemented a 50% levy on various Canadian products using Section 338 following the breakdown of trade negotiations in August. Subsequently, in the following month, the same statute was employed to prohibit the import of additional Canadian goods such as motorcycles, alcohol, and dairy products.

The lawsuit contends that the Canadian policies do not warrant the broad tariffs imposed by the Trump administration. While the White House claims that Section 338 allows the president to levy tariffs when U.S. exporters are disadvantaged compared to other countries, this provision has never been used for such purposes before.

The legal challenge highlights that the tariffs have repercussions not only on importers but also on consumers in both countries, affecting the historical relationship between the United States and Canada. Despite acknowledging tariffs as a key policy of the Trump administration, Liberty Justice Center argues that their implementation in this instance violates the Constitution.

A Trump administration official defended the president’s actions, emphasizing the commitment to leveling the playing field for American workers, farmers, and firms. The lawsuit seeks to declare the tariffs unlawful and demands a refund, expressing concerns that unchecked duties under Section 338 could allow any future president to impose tariffs without substantial congressional oversight.

Gellert Global Group, deeply impacted by the trade war, emphasized the disruption caused to their business relationships and supply chain by the sudden imposition of tariffs. The company faces challenges from both the U.S. and Canadian sides due to reciprocal tariffs on imports and exports, illustrating the complex impacts of the ongoing tariff dispute.

The lawsuit signifies broader implications beyond the Canada-U.S. trade relationship, aiming to prevent unchecked presidential authority in imposing tariffs and trade restrictions. The Liberty Justice Center has a history of challenging similar actions, including Trump’s use of the International Economic Emergency Powers Act of 1977, which was deemed unconstitutional by the U.S. Supreme Court earlier this year.
