Tyler Robinson, the individual charged with the fatal shooting of well-known U.S. conservative activist Charlie Kirk on a Utah college campus last year, entered a plea of not guilty on Tuesday to a murder charge that could result in the death penalty, according to a ruling by Utah District Court Judge Tony Graf.

The plea and the judge’s decision followed the prosecution’s presentation of compelling evidence supporting a capital trial for Robinson, 23, in connection with the killing of one of the leading figures in the U.S. conservative movement. Defense attorneys contended that the shooting did not meet the criteria for a death penalty offense.

Prosecutors in Utah County alleged that the former apprentice electrician was responsible for firing the fatal shot that ended Kirk’s life at the age of 31 while Kirk was engaged in one of his signature campus debates that helped elevate his national profile.

Judge Graf determined that Robinson should stand trial on all seven charges against him, including aggravated murder for putting others’ lives at risk during the incident, a charge that carries the death penalty in Utah.

The video evidence presented by Utah County prosecutor Ryan McBride purportedly showed Robinson assuming a sniper position at Utah Valley University in Orem on the day of the shooting, before targeting and firing at Kirk. McBride emphasized that the shots fired posed a significant threat to the safety of individuals present, with Kirk’s security detail being in close proximity to him at the time of the shooting.

According to McBride, the presence of four rounds in Robinson’s rifle indicated a readiness to fire additional shots if needed, further endangering bystanders. The prosecutor detailed how Robinson positioned himself, took aim at Kirk, and fired the fatal shot in a calculated manner.

In contrast, defense attorney Staci Visser argued that the shooting only endangered Kirk and did not meet the legal standards for aggravated murder. Visser pointed out that the assailant did not interact with anyone else or attempt to reload the weapon after firing the fatal shot.

During the hearing, the prosecutor referenced DNA test results linking Robinson to the alleged murder weapon, while the defense questioned the reliability of the testing procedures.

McBride alleged that Robinson, who was reportedly in a relationship with his roommate Lance Twiggs, targeted Kirk due to his staunch views against same-sex marriage and transgender rights. This assertion could bolster the prosecution’s case as they pursue the death penalty. McBride cited a text message from Robinson to Twiggs indicating that the shooting was motivated by irreconcilable hatred.

On the other hand, defense attorney Richard Novak raised doubts about the interpretation of Robinson’s message and argued that it did not necessarily imply opposition to Kirk’s political stances.

Among those attending the courtroom proceedings were Kirk’s family members, including his parents and wife Erika, who has taken over leadership of Kirk’s conservative youth organization following his tragic death.

Charlie Kirk, a co-founder of the conservative youth group Turning Point USA, was known for mobilizing young voters in support of former President Donald Trump’s 2024 re-election campaign. Erika Kirk, speaking at a memorial service for her late husband, expressed forgiveness towards the alleged shooter but has not commented on the death penalty aspect of the case.
