The Yukon Court of Appeal has rejected the appeal of a man contesting his sentence for sexual assault in a recent ruling.
Rudra Amin, currently residing in Calgary, was convicted in 2023 of sexually assaulting three women in Whitehorse between 2017 and 2018. The victims reported the incidents in 2020, leading to Amin being found guilty of four counts of sexual assault following a trial by jury.
Following his sentencing, Amin promptly lodged an appeal and was subsequently granted bail. In his appeal, Amin sought a reduction of his slightly over two-year sentence by two months to qualify for a conditional sentence order, citing concerns about potential immigration repercussions in court documents.
Justice Susan Griffin, in her decision released on Aug. 6, dismissed the appeal. Griffin refuted Amin’s assertion that the original sentencing judge had erred and deemed Amin’s plea for a conditional sentence inappropriate.
Griffin emphasized that Amin’s plea to shorten his sentence by two months lacked merit unless he could demonstrate a fundamental error influencing the sentence. “This is simply tinkering and not this court’s proper role,” the decision by Griffin stated.
Amin is now set to serve his original sentence of slightly over two years.
