A man from Ontario faced animal cruelty charges in a Las Vegas court for taking a flamingo named Peachy from its habitat at a hotel. The incident, described as a drunken and malicious act by prosecutors, occurred in the early morning hours of March 3. Mitchell Fairbarn, the accused, pleaded not guilty and his trial commenced recently.
Following the jury’s decision on felony and misdemeanor animal cruelty charges, Fairbarn awaits sentencing on December 1. The felony conviction could lead to up to four years in prison, with an additional six months for the misdemeanor charge.
Fairbarn, identified as a contractor from rural Ontario, expressed regret in court, mentioning that he consumed “30 to 40” beers during a work trip to Las Vegas. He admitted to entering the Flamingo Las Vegas Hotel and Casino habitat and taking Peachy thinking it would be a humorous prank.
Video evidence displayed Fairbarn holding the flamingo and spending time with it in his hotel room. Witnesses testified that Fairbarn and his friends were intoxicated when the incident occurred. Peachy suffered injuries, including missing feathers and blood loss, requiring medical treatment and pain medication.
Fairbarn’s lawyer attributed the actions to intoxication, emphasizing that no harm was intended towards the bird. Fairbarn has been under house arrest since the incident and had to surrender his passport. The court proceedings involved closing arguments, leading to deliberations by the jury.
Fortunately, Peachy has recovered well, as confirmed by a spokesperson from Caesars Entertainment, which manages the Flamingo Wildlife Habitat. Animal rights advocates expressed satisfaction with the verdict, emphasizing the importance of protecting animals from cruelty in Nevada. The incident involving Peachy is one of several recent cases of animal mistreatment in Las Vegas establishments.
